Welcome to Padel4Eva. The terms “we”, “us” and “our” refer to Padel4Eva. Padel4Eva operates this website and online store, including all related information, content, features, tools, products and services (collectively, the “Services”) to provide you with a premium online shopping experience. Our store is powered by Shopify.

These Terms of Service (“Terms”), together with any policies referenced herein, set out the terms under which you may access and use our Services. By visiting, browsing, or purchasing from our store, you agree to be bound by these Terms and our Privacy Policy [LINK]. If you do not agree, please do not use our Services.

SECTION 1 – ACCESS AND ACCOUNT

By using our Services, you confirm that you are 18 years of age or older.

You may be required to provide personal information such as your email address, billing, payment, and shipping details. You confirm that all information provided is accurate, current, and complete, and that you are authorised to use the payment method supplied.

You are responsible for maintaining the confidentiality of your account credentials and for all activity conducted through your account. Accounts may not be transferred, sold, or assigned to another person.

SECTION 2 – OUR PRODUCTS

We make every effort to display our products accurately. However, colours and product appearance may vary depending on your device, screen settings, and display configuration.

All product descriptions, pricing, and availability are subject to change without notice. We reserve the right to discontinue or limit the quantities of any product at any time.

Padel equipment is intended for sporting and recreational use only. By purchasing and using our products, you acknowledge that participation in sport carries inherent risks of injury. Padel4Eva shall not be held liable for any injury, loss, or damage arising from misuse of products, failure to follow manufacturer instructions, or participation in sporting activities.

Product Images & Descriptions Disclaimer

Product images are for illustrative purposes only. Actual products may vary slightly in colour, appearance, packaging, or design depending on manufacturer updates or screen display differences.

While we strive for accuracy, we do not warrant that product descriptions, specifications, pricing, or other content on the Services are error-free, complete, or current. In the event of an obvious error (including pricing or specification errors), we reserve the right to correct such errors and cancel or amend affected orders.

SECTION 3 – ORDERS

Placing an order constitutes an offer to purchase. Orders are only accepted once payment has been successfully processed and stock availability (including supplier stock where applicable) has been confirmed.

All orders are subject to product availability. While we make reasonable efforts to ensure stock accuracy, inventory levels — including items marked as “in stock at supplier” — are based on information provided by third parties and may change without notice.

If a product becomes unavailable after an order has been placed or paid for, we reserve the right to cancel the order (in whole or in part). In such cases, we will notify you and provide either:

  • A full refund for the unavailable item; or

  • The option to select an alternative product (where available).

We shall not be liable for supplier stock shortages beyond our reasonable control.

We reserve the right to accept or decline orders at our discretion. Once an order has been accepted, cancellations or changes may not be possible.

If we need to amend or cancel an order, we will attempt to notify you using the contact details provided at checkout.

All purchases are subject to our Returns, Refunds & Exchanges Policy [LINK].

Certain items, including padel rackets, grips, balls, and bags, may not be eligible for return or exchange once opened or used, due to hygiene and sporting-use considerations, except where damaged or defective on delivery, as outlined in our Returns Policy.

Products are sold for personal use only and may not be purchased for resale or export.

SECTION 4 – PRICES AND BILLING

Prices, promotions, and availability are subject to change without notice. The price charged will be the price displayed at the time the order is placed.

Prices exclude delivery fees, customs charges, and applicable taxes unless stated otherwise. Promotions may be subject to additional terms and conditions.

You agree to provide valid payment information and authorise us to charge your selected payment method for all amounts due.

SECTION 5 – PAYMENT SECURITY & FRAUD PREVENTION

We reserve the right to refuse, cancel, or reverse any transaction that appears fraudulent, unauthorised, or suspicious. We may request additional verification before processing or dispatching an order.

Chargebacks or payment disputes may result in order cancellation, account suspension, or refusal of future orders.

SECTION 6 – SHIPPING AND DELIVERY

Delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by couriers, customs processing, or events beyond our control.

Once an order has been handed over to a third-party courier, delivery is subject to the courier’s terms and conditions. While we are not responsible for loss, delay, or damage caused during transit, we will assist customers in resolving delivery issues or submitting courier claims where reasonably possible.

SECTION 7 – INTELLECTUAL PROPERTY

All content on the Services, including trademarks, logos, text, images, graphics, videos, and design elements, is owned by or licensed to Padel4Eva and is protected by applicable intellectual property laws.

You may use the Services for personal, non-commercial purposes only. Any unauthorised use, reproduction, or distribution of content is prohibited.

SECTION 8 – OPTIONAL TOOLS

We may provide access to third-party tools or services that we do not control. These tools are provided “as is” and “as available”, without warranties or endorsements.

Your use of optional third-party tools is entirely at your own risk.

Our Services may include links to third-party websites. We are not responsible for the content, accuracy, or practices of these external sites. Accessing third-party websites is at your own discretion and risk.

SECTION 10 – RELATIONSHIP WITH SHOPIFY

Padel4Eva uses Shopify to power its online store. All purchases are made directly with Padel4Eva. Shopify bears no responsibility for transactions, products, or disputes arising from your purchase.

SECTION 11 – PRIVACY

Your personal information is handled in accordance with our Privacy Policy [LINK] and Shopify’s Privacy Policy. By using our Services, you consent to the collection and use of your information as described therein.

SECTION 12 – ELECTRONIC COMMUNICATIONS

By using the Services or placing an order, you consent to receive communications from us electronically, including via email, SMS, WhatsApp messages or website notices.

You agree that all agreements, notices, disclosures, confirmations, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

You are responsible for providing and maintaining accurate contact information and for checking your email (including spam or junk folders) for important communications relating to your order.

Any feedback, reviews, or suggestions you submit may be used by Padel4Eva for operational, analytical, and promotional purposes without compensation. You confirm that you own or have permission to submit such content and that it does not violate any third-party rights.

SECTION 14 – ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability.

We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

We are not obligated to update, amend, or clarify information except as required by law.

You agree not to use the Services for unlawful purposes, to infringe intellectual property rights, transmit malicious software, collect personal data unlawfully, or interfere with the security or operation of the Services.

All warranties, where applicable, are provided by the original manufacturer or supplier. Padel4Eva does not provide independent warranties beyond those offered by the supplier and does not accept responsibility for manufacturer defects outside the applicable warranty process.

Nothing in these Terms is intended to limit any rights you may have under applicable law.

SECTION 18 – LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Padel4Eva shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, business opportunity, goodwill, or data, arising out of or related to the use of the Services or products purchased.

Padel4Eva shall not be liable for:

  • Losses resulting from misuse of products;

  • Failure to follow manufacturer instructions;

  • Normal wear and tear;

  • Delays caused by third-party couriers;

  • Events beyond our reasonable control;

  • Errors caused by third-party suppliers.

In all circumstances, and to the extent permitted by law, Padel4Eva’s total aggregate liability arising from any claim relating to a product or Service shall not exceed the total amount paid by you for the specific product giving rise to the claim.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable South African law, including rights afforded to consumers under the Consumer Protection Act.

SECTION 19 – INDEMNIFICATION

You agree to indemnify and hold harmless Padel4Eva, its service providers, and partners against any claims, losses, or damages arising from your breach of these Terms or misuse of the Services.

SECTION 20 – SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

SECTION 21 – ENTIRE AGREEMENT

These Terms, together with our policies, constitute the entire agreement between you and Padel4Eva and supersede any prior agreements or understandings.

SECTION 22 – ASSIGNMENT

You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.

SECTION 23 – GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

SECTION 24 – CHANGES TO TERMS

We may update these Terms from time to time. Continued use of the Services following any changes constitutes acceptance of the revised Terms.
